Improvement of Chinas Energy Law and Its Related Legal System

Abstract


The Third Plenary Session of the Twentieth Central Committee of the Communist Party of China (CPC) emphasised the core axis of
institution-building, with a view to solidly building a fundamental system, improving the basic system and innovating the important system.
As the worlds largest energy producer and consumer, China has long lacked a basic law in the field of energy that embodies the countrys
energy strategy and policy orientation, regulates the basic rights and obligations of all parties involved in energy activities, and guarantees
energy security. The Energy Law was promulgated to stipulate the guidelines, principles, and systems of Chinas energy development, and to
serve as a cornerstone for the main structure of the energy legal system. It is of great significance to energy security, green transformation and
sustainable development. However, as a fundamental law, the effectiveness of the energy law depends on the perfection of the supporting laws
and regulations, and the absence or imperfection of the supporting laws and regulations will directly affect the implementation of the energy
law, and may even lead to the failure to effectively implement the goals stipulated in the law. This paper analyses the obvious deficiencies of
the domestic energy law system by analysing the existing energy laws and regulations, and at the same time draws on the energy laws and legislation of overseas countries to trigger thinking about the imperfections of Chinas energy legislation and put forward relevant suggestions for
specific problems.
