On the Subject of Tort Liability in Artificial Intelligence Autonomous Driving

Abstract


Globally, countries are actively advancing the research and development of unmanned vehicles which is seen as an expanding
competitive trend within the automotive industry. Conceptually, unmanned vehicles are believed to offer better environmental benefits and improved road safety. However, in practice, these vehicles may become involved in traffic accidents due to various factors. Such scenarios differ
significantly from traditional vehicle usage particularly in terms of accident causes and liability allocation. When an unmanned vehicle is involved in a road accident there is an urgent need to clarify the identification of responsible parties and the applicability of liability principles.
It is also essential to assess whether existing legal regulations designed for human-driven vehicles remain suitable for this new technology.
Nonetheless, issues such as difficulty in identifying the liable party confusion in applying principles of liability attribution and complexities in
establishing causation persist in the realm of unmanned vehicle tort liability. These challenges represent pressing legal problems that need to
be urgently addressed.
