Research on Intellectual Property Ownership of Content Generated by Artificial Intelligence

Abstract


The rapid development of generative artificial intelligence has promoted the deep integration of AIGC into the field of content
creation, posing a systematic challenge to the traditional copyright system. This article focuses on the issue of intellectual property ownership in AIGC, sorting out theoretical differences such as the "tool theory", "investor theory", and "user theory". From three aspects: the core
dimension of judicial review, the common characteristics of judgment standards, and the limitations of practical exploration, it analyzes the
current difficulties in legal application, such as unclear work attributes, unclear originality standards, and disputes over subject qualifications.
Research suggests that we should adhere to the human centered position of authors, determine the ownership of rights based on the substantial intellectual contribution of humans in the process of generation, refine the criteria for originality judgment, improve the identification
and traceability system, establish a supplementary protection mechanism for adjacent rights, and construct a copyright protection system that
adapts to the era of artificial intelligence, in order to balance the relationship between technological innovation and rights protection.
