On the Practical Dilemma and Breakthrough Path of the Choice of Court Agreement in the Jurisdictional Rules of International Commercial Litigation
Abstract
With the increasing frequency of international commercial exchanges, international commercial disputes have also increased. As
an important way of determining jurisdiction in international commercial litigation, the Choice of Court Agreement (Choice of Court Agreement) plays a key role in practice. However, due to the differences in the legal systems and judicial practices of various countries, the Choice
of Court Agreement faces many dilemmas in the practical application of the rules of jurisdiction in international commercial litigation. The
purpose of this article is to analyse these dilemmas in depth and explore feasible breakthrough paths, so as to promote the improvement of the
rules of jurisdiction in international commercial litigation and the effective application of the Choice of Court Agreement in practice.
